INDIGO BLOOM YOGA & WELLNESS, LLC
AGREEMENT OF RELEASE AND WAIVER OF LIABILITY
I understand that yoga includes physical movements as well as an opportunity for relaxation, stress reduction and relief of muscular tension. I understand I will receive information and instruction; including verbal and physical adjustments about yoga and health. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. It is my responsibility to consult with a physician prior to my participation in the yoga class. It is also my responsibility to inform the instructor that I do not wish to receive physical adjustments during class.
I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in the yoga class. I am aware I may be physically adjusted. I agree to take full responsibility for any risks, loss, claim, injury, damage or liability, known or unknown, which I might incur as a result of participating in the program.
Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. I affirm that I alone am responsible to decide whether to practice yoga. I knowingly, voluntarily, and expressly agree to accept full responsibility and assume the risk for my use of or participation in any and all classes, activities, apparatus, appliance, facility privilege or service, of any nature, which is owned or operated by Indigo Bloom Yoga & Wellness, LLC. While engaging in any class or activity operated, organized, arranged or sponsored by Indigo Bloom Yoga & Wellness, LLC, either on or off their premises, I shall do so at my own risk, and hold Indigo Bloom Yoga & Wellness, LLC, its employees, representatives and agents, forever harmless from any and all loss, claim, injury, damage, or liability sustained or incurred by me. I specifically agree to indemnify and hold harmless Indigo Bloom Yoga & Wellness, LLC as to any loss, cost, claim, injury, damage or liability, sustained or incurred by participating in the classes, or through my use of the facilities or equipment of Indigo Bloom Yoga & Wellness, LLC which is caused by an act or omission, whether negligent, intentional or otherwise, of an employee, representative, or agent of Indigo Bloom Yoga & Wellness, LLC.
If I do have a physical condition which limits my participation, I take full responsibility for moderating my activity and being aware of my own limitations. I will keep in communication with my teacher and ask questions while listening to instructions carefully. I have told my health professional about taking this program.
COVID-19 has been declared a worldwide pandemic by the World Health Organization. Indigo Bloom Yoga has put in place preventative measures to reduce the spread of COVID-19 in its studios; however, Indigo Bloom Yoga & Wellness, LLC cannot guarantee you will not become infected with COVID-19. By signing this agreement, I acknowledge the operational policies above as well as the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by entering Indigo Bloom Yoga & Wellness, LLC studios and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Indigo Bloom Yoga & Wellness, LLC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, independent contractors, volunteers, and other Indigo Bloom Yoga & Wellness, LLC members or participants. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with Indigo Bloom Yoga & Wellness, LLC programming (“Claims”). On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless Indigo Bloom Yoga & Wellness, LLC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Indigo Bloom Yoga & Wellness, LLC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Indigo Bloom Yoga & Wellness, LLC program.
I, hereby release, indemnify, and hold harmless Indigo Bloom Yoga & Wellness, LLC, its employees, agents, independent contractors, and volunteers from all liability for any and all claims of damage, loss, or theft of personal property while on the property of Indigo Bloom Yoga & Wellness, LLC including parking areas, change areas, locker areas, and restrooms.
I, my heirs, or legal representative forever release, waive, discharge and covenant not to sue Indigo Bloom Yoga & Wellness, LLC for any injury or death caused by my participation in the yoga class. My signature below constitutes my full acceptance of this waiver.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "RELEASE AND WAIVER" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST FOR PERSONAL INJURY OR PROPERTY DAMAGE.
Cancellation Policy
REGULARLY SCHEDULED CLASS POLICY
You may cancel your reservation at Indigo Bloom Yoga & Wellness up to 1 hour before the scheduled class start time. Single class purchases will retain the purchase and be able to schedule a class at a different time. Clients who hold a class package or unlimited package will not be penalized.
ALL CLIENTS (single class or package holders) who cancel within 1 hour of the scheduled class or fail to attend class time will be penalized.
Single Class purchases will lose the class and payment made to reserve their spot.
Multi-class package holders will lose 1 class as they used to reserve their spot.
Unlimited package holders will be charged a $5 cancellation/no show fee.
Due to the rise in infection numbers in relation to the COVID-19 Pandemic, class sizes will not be at full capacity as some social distancing will be imposed. We appreciate your understanding and acknowledgement of this policy as it currently stands and may be subject to change.
SPECIAL EVENT & WORKSHOP POLICY
Events and workshops are separate from regular scheduled classes at Indigo Bloom Yoga & Wellness and require special planning along with the procurement of a host in advance, clients will ONLY receive a FULL REFUND if their reserved spot is cancelled up to 3 hours prior to the scheduled start time.
Due to the limited capacity of these events that may be set by Indigo Bloom Yoga & Wellness or the special host, clients who cancel within 3 hours of the scheduled start time, fail to cancel or do not attend will be charged a cancellation/no show fee of 50% of the price of the workshop or event. We appreciate your understanding and acknowledgement of this policy as it currently stands and may be subject to change.
Purchase Policies
SINGLE CLASS & PACKAGE PURCHASES
All sales of single class and package purchases are final. Single class and package purchases are non-refundable and non-transferable.
Purchase of a single class pass must be used within 3 months of the purchase date.
Purchase of a 5 Class or 10 Class pass will expire 6 months after the purchase date.
Purchase of a 30 Day Unlimited or 3 Month Unlimited package will expire in the respective time after the clients first visit.
RETAIL PURCHASES
All retail purchases at Indigo Bloom Yoga & Wellness are non-refundable. If you are not happy with your purchase, need a different size, or the product is defective, you may exchange the product for another in-store item of equal or lesser value. If you choose an item of lesser value - no refund will be given for the difference in price. If you chose to exchange your item for a product of greater value you will be responsible to make the difference in payment at the time of the exchange.
All exchanged items must be presented with proof of purchase.
